A Dewitt man's time in prison for leading Syracuse police on a chase with a dump truck could end in a couple of weeks due to a state appeals court ruling.
Stanley Lostumbo was convicted in November 2011 of first degree reckless endangerment after he fled in the dump truck when police tried to stop him from stealing a vending machine. The Supreme Court Appellate Division determined that Lostumbo should have been charged with second-degree reckless endangerment because there wasn't evidence he acted with depraved indifference to human life. Lostumbo was convicted of trying to run down several police officers, but he said he was only trying to get away. Lostumbo was re-sentenced to three years, most of which he has already served.
